KHG MEMBER QUESTIONS

1) WHAT IS THE PURPOSE OF KHG?
KHG should be about preserving the nature and character of our community, providing administrative services, protecting property values and meeting the established expectations and direction of our KHG Members as we strive to build and sustain a vision of KHG that we all want to call home.
KHG Community also provides some degree of protection against neighborhood degradation and deterioration – such as eyesores like accumulated junk, dilapidated homes or yards that are not maintained. This requires not only creating reasonable community standards, but also enforcing rules articulated in the KHG DPRs.
Many of KHG’s homebuyers value the benefits of living in our community and understand their HOA obligations.
Our KHG community is governed by homeowner volunteers who are elected or appointed by their fellow owners to set policy and oversee the business of the association. The KHG Board serves the KHG Members to ensure that the foregoing is maintained for the benefit of all homeowners, meeting the expectations of same to ensure KHG’s future.
2) WHAT IS THE PURPOSE OF THE KHG BOARD?
The KHG Board has a fiduciary duty – to act for all of our homeowner’s benefit, while subordinating one’s personal interest -- to protect, preserve and enhance the assets and lifestyle of our KHG Community.
KHG Board Directors are required to exercise their duties in accordance with our KHG Governance (Articles Of Incorporation/By-Laws/DPRs/Election Rules), by following Davis-Stirling, operating within CA Civil Code reporting to regulatory bodies overseeing non-profit CA Corporations. They are charged with conducting the business of KHG in a mindful and responsible manner offering up full transparency in their process to fellow KHG Board Directors, all KHG Members and others as required to ensue the proper communication of the intent and actions of the KHG Board.
The KHG Board has a duty of care – being diligent and careful in performance of their duties – and a duty of loyalty – refraining from doing anything that would harm KHG’s interests -- and must uphold itself to the highest ethical standard to serve the interests of our KHG Members.
Since KHG Board Directors are entrusted with KHG funds, they must avoid conflicts of interest and provide regular / verifiable / accounting to KHG Members and enlist their input as to the priorities of the annual KHG budgeting process.
3) HOW DO YOU PLAN TO ENFORCE THE PROVISIONS OF THE DPRS?
The KHG Board is charged with the sole responsibility to enforce our KHG -- Declaration Of Protective Restrictions – DPRs. We must update the DPRs to reflect the current standards of our KHG community, LA City Building Codes and CA State law. Then provide outreach to our KHG Members to ensure their participation in that process. Our DPRs should be inclusive and the result of KHG Member input so all will buy into the ARC Application process and understand their obligations to maintaining KHG Community Standards. Here are some proposed steps for KHG Board enforcement of our DPRs:
- Update our DPRs to reflect current standards of our KHG Community, LA City Building Codes and CA State Laws
- Act on recommendations from the ARCC to administrate DPR Enforcement in a timely and responsible manner
- Put in place a set of prioritized letters of notice and automate a process that would require the KHG Board send to KHG Members to notify of non-compliance and open dialogue on remedies
- Tract non compliance and follow-up on KHG Member complaints with LADBS or other entities that our KHG DPRs may not adequately cover, such as unkempt properties or illegal ADU builds, etc.
- Immediately set aside $10K of the $20K recently approved in KHG Legal Expenses per the new 2024-25 KHG Annual Budget for KHG DPR enforcement
